On 24 April, the High Qualification Commission of Judges of Ukraine with the support of US Agency for International Development FAIR Justice Project, OSCE/ODIHR  and EU Project “Support to Justice Sector Reform in Ukraine”, organised the workshop “Judicial Performance Evaluation”.

The event was organised in connection with legislative amendments to the Law of Ukraine “On the Judiciary and the Status of Judges” introducing qualification evaluation of judges. HQC is entitled to organise such evaluation according to the procedure agreed with the Council of Judges of Ukraine and to the criteria defined by law. Respect of recognized standards of judicial independence is an important part of such work.

Members and staff of the High Qualification Commission of Judges of Ukraine, High Council of Justice, Council of Judges of Ukraine, representatives of the National School of Judges, judicial corps, and researchers participated in the event. The experts from the Netherlands, Lithuania, Germany, Serbia, Moldova and Australia, with the relevant experience in judicial performance evaluation were invited to the workshop. The representatives of the donors, supporting judicial evaluation procedure and disciplinary practice in Ukraine, were present as well.

“After having adopted the new version of the Law “On the Judiciary and the Status of Judges”, the Commission has faced the mission to implement a unified, transparent and standardized judicial evaluation procedure in Ukraine. This workshop aims to organise a forum for presentation of the international practices, consideration of the mistakes of other countries and discussion of the optimal ways to introduce the judicial performance evaluation system in Ukraine,” – said David Vaughn, Chief of the Party, USAID FAIR Justice Project.

The participants of the event discussed the principles, criteria, forms and methods of judicial performance evaluation introduced and applied in many countries.

“The donors’ community will assist the High Qualification Commission of Judges of Ukraine with development of qualification evaluation criteria in compliance with the international standards. The task of the Commission is to complete the evaluation in such a manner that judges would not be demeaned, that our decisions would be clear for everybody. The evaluation procedure will be transparent and presented long before the evaluation starts,” – said Serhii Koziakov, Head of the High Qualification Commission of Judges of Ukraine.

The workshop will result in drafting recommendations to the High Qualification Commission of Judges of Ukraine on the implementation of a stable mechanism and procedural rules of judicial performance evaluation in Ukraine that will take into account the best practices and will comply with international standards.

“EU Project “Support to Justice Sector Reforms in Ukraine has stood at the origins of implementation of the judicial performance evaluation mechanisms. In that way, the Ukrainian Judiciary Development Strategy 2015-2020, drafted with assistance of the Project and approved by the Council of Justice, envisages development of the judicial performance evaluation as a mechanism for increasing efficiency of judges’ performance. First legislative consolidation of this mechanism in the Law “On fair trial” is a logical step in this direction,” – said Virgilijus Valancius, Team Leader of EU Project “Support to Justice Sector Reforms in Ukraine”.
