Ukrainian Bar Association with the assistance of the EU Project “Support to Justice Sector Reforms in Ukraine” initiated a series of roundtables to carry out analysis and exchange the opinions on the amendments of the Law of Ukraine “On the Bar and the Practice of Law”.
Within the framework of this initiative on 02 December, 2015 the first discussion was held under the title “Exclusive right to representation in courts. Entry to the profession”.
Expert of the EU Project “Support to the Justice Sector Reform in Ukraine” Rytis Jokubauskas spoke about the European experience of the bar monopoly for representation of persons’ interests in courts. “In the EU countries the bar monopoly to greater extent applies to the representation in criminal proceedings. The most appropriate format for Ukraine is to combine the exclusive right of representation by the bar with self-representation options for civil cases, where legal entities could be represented by their corporate lawyers,” – Mr. Jokubauskas said.
Participants of the roundtable also discussed the status of the advocate, issue of entry to the profession and reforms of the advocates’ qualification examination. The next event “Professional rights and guarantees. Access to the information and advocate’s inquiry” is scheduled for 09 December 2015.
